New Advance Directive Law in Utah Changes Living Wills for HealthcareThe Utah Advance Health Care Directive Act will go into effect on January 1, 2008. This law replaces Utah’s Living Will and Special Power of Attorney with a new form. In addition, it changes determination of incapacity, surrogate decision making, and other health care operations. UMA will print and sell the new document booklets (forms and instructions) in place of the old Living Will packet. The older documents filled out prior to January 1st will continue to be valid, but using the new forms may make clearer the patient’s wishes for end-of-life care. After January 1, 2008, only the new Advance Directive forms should be used. See the December 2007 UMA Bulletin for an article on the new law and forms. Pricing for the new Advance Directive booklets is currently the same as for the old Living Will packets: $3.50 per single booklet mailed ($2.50 if picked up at the UMA office). Orders of 100 or more will cost $.90 each plus shipping.
